Employee Benefits

ERISA is the federal law controlling many employee benefit issues. Michael H. Rosenthal has been representing clients in ERISA matters since 1995. First, as a Senior Attorney for the United States Department of Labor, he litigated enforcement actions against plan fiduciaries that mismanaged plan assets or authorized transactions specifically prohibited by ERISA. Next, as an attorney with a large, Philadelphia based law firm, he counseled employers, plan fiduciaries and plan service providers in a broad array of ERISA matters ranging from individual disability, severance and pension benefits claims to class action litigation involving issues such as discrimination, worker misclassification, and fiduciary breaches.

Michael now brings this blend of government and large firm experience to employees and small to mid-size employers requiring advice and representation in this complicated area of the law. He understands that, for employees, benefits are a critical part of their financial security. For employers, plan administrators and fiduciaries, the rules, regulations and court interpretations are not always clear and require careful review to ensure compliance. In either instance, good legal counsel will help clarify rights and responsibilities.
